Electronic cigarettes, e-liquids and devices for consuming tobacco products without burning them are prohibited for sale to persons under 18 years of age. This rule applies to all sellers without exception.

If the employee doubts the buyer's age, he must ask for a document confirming the age.

The action algorithm is simple:
1- politely ask for a document and check the date of birth,
2- in the absence of the document - clearly refuse the sale.

"The sale of electronic cigarettes and liquids to persons under one year old is prohibited. Please show proof of age. If there is no document, I cannot make a sale."

What to do when an adult wants to buy for a minor?

This is a very popular situation, because minors often ask older sisters/brothers, friends or just acquaintances to buy them the products they need.

How to act as a seller:

1 - If a teenager chooses a product, asks questions about flavors or strength, and an adult only pays, take it as a risky situation.

2 - Feel free to clarify: "The goods are purchased for you personally"?

3 - In Ukraine, there is no separately prescribed step-by-step formulation specifically for the case when an adult tries to buy goods for a teenager. Therefore, if it is obvious that an adult is buying a product for a minor, explain that electronic cigarettes and related products are only allowed to be sold to people who have reached the age of 18.

Such situations are not new.
They have always been there: both today, and in our childhood, and in the childhood of our parents. Teenagers have always tried to bypass restrictions.

That is why sellers play a key role in informing minors.

We remind you: responsibility for violating the requirements of the law is borne by both the business entity and the employee who made the sale to a minor.

Financial sanctions are applied for violating the requirements of Article 71 of Law No. 3817, and the employee is subject to administrative liability under Article 156 of the Labor Code.
