VARES at a business community meeting with representatives of the Prosecutor General's Office
Main topics for discussion:
- the results of the STOP_TYSK platform,
- new approaches to concluding agreements in criminal proceedings,
- the state of consideration of the draft law on strengthening procedural guarantees of protection,
- the position of the Prosecutor General's Office regarding the pre-trial settlement of tax offenses.
In particular, the following issues were discussed:
- lengthy pre-trial investigations,
- return of seized property,
- use of criminal proceedings in corporate disputes,
- cases when tax issues with an ambiguous interpretation of the legislation move into the criminal legal sphere.
The representative of the General Prosecutor's Office noted that 9,300 cases have already been closed as a result of the review of criminal proceedings related to business.
This indicates both the scale of the situation and the result of the dialogue between business and the prosecutor's office.
During the meeting, the head of the VARES Association, Andriy Solomin, had the opportunity to make a presentation on the state of the electronic cigarette market in Ukraine.
It was highlighted:
- current market structure,
- the dynamics of tax revenues,
- the impact of legislative changes on the legal segment,
- the scale of shadow trade and the role of law enforcement agencies in countering illegal trade.
We also emphasized that the positive dynamics of revenues indicates the gradual strengthening of the legal segment.
However, further legislative changes, effective work of the State Security Service, the Prosecutor's Office, and the DPS, as well as systematic countermeasures against the illegal market are needed for full-fledged detinization of the market.
That is why VARES is preparing a large analytical presentation.
In which these issues will be covered more widely and in more detail: with figures on tax revenues, an analysis of the market structure, an assessment of the impact of regulatory changes and specific proposals for further detinization.
If we really want to detinize the market, we need:
- support white players,
- to stop the activities of those who build business on tax evasion and illegal circulation of products.
